    Respected Comrade,

    With references to so many representation regarding grant of ACP & MACP scheme to erstwhile NIE ‘D’ cadres of Ordnance Factory Organisation, pending before OFB & MoD, I would like to draw your kind attention on the subject matter through a CASE SUMMARY for implementation of ACP & MACP scheme to erstwhile NIE ‘D’ cadres in proper & justified manner without any partiality in Ordnance Factory Organisation, after upgradation & merger of feeder & promotional post pre revised pay scales i.e. Rs.2550–3200, Rs.2610–4000 &nRs.2750–4000 in revised Grade pay structure Rs. 1800/- in 6th CPC under existing Recruitment/Service Rules, 1989 is that:-

    After implementation of 6th CPC the pay structure has been changed w.e.f. 01.01.2006, as per recommendation of 6th CPC, implementation of MACP scheme through DOPT OM No. 35034/3/2008-Estt.(D) dated 19.05.2009, clarification at para 9 of DOPT OM dated 19.05.2009 the MACP scheme would be operational w.e.f. 01.09.2008 as per provisions of the earlier ACP scheme would be granted till 31.08.2008 & para 6.1 in its Annexure–I that, in the case of ACP Up-gradations granted between 01.01.2006 to 31.08.2008, the Govt. servant has the option under the CCS (RP) Rules, 2008 to have his pay fixed in the revised pay structure w.e.f. the date of his financial upgradation under ACP with reference to the pre revised scale granted under ACP & at point No. 03 in DOPT OM No.35034/3/2008-Estt.(D) dated 09.09.2010, the said clarification relates with grant of ACP benefits, if due, between 01.01.2006 to 31.08.2008, that previous ACP scheme would be applicable in the new pay structure adopted w.e.f. 01.01.2006. Hence Example (B) is applicable on the subject matter.

    Accordance to Recruitment/Service Rules, 1989; the post of Messenger Boy/Orderly/Duftry/ Poddar/Blue Printer/Record Supplier is not an isolated post in Ordnance Factories Organisation. As per existing Ordnance and Ordnance Equipment Factories Group ‘C’ and Group ‘D’ Non-Industrial posts {Recruitment and conditions of Service) Rules, 1989; SRO–14(E) dated 04.05.1989 & its amendment Recruitment Rules, 1991; SRO–149 dated 26.07.1991 for the purpose of promotion (Recruitment by promotion/transfer), the feeder pre revised pay scale of Messenger Boy/Orderly grade Rs. 2550 – 3200 (S–1) & promotional pre revised pay scales of Duftry/Poddar/ Blue Printer & Record Supplier grade i.e. Rs. 2610–4000 (S–2A) & Rs. 2750–4000 (S–4) upgrade & merged with direct entry grade and initially revised Grade pay Rs. 1800/- in 6th CPC grade pay structure w.e.f. 01.01.2006 and as per norms of ACP scheme the residency periods (regular service) for grant of benefits under the ACP Scheme shall be counted from the grade in which an employee was appointed as a direct recruit. Hence after upgradation & merger of pre revised pay scales (S–1, S–2 A & S–4) of above feeder & promotional post in the group ‘C’ initially revised Grade pay structure Rs.1800/- in the Pay Band–1 in the 6th CPC w.e.f. 01.01.2006, as per existing Recruitment/Service Rules, 1989; SRO–14(E) of 1989 & its amendment Recruitment Rules, 1991; SRO–149 of 1991, the post of Tracer will be fill/ Recruitment by promotion/transfer from Blue Printer & Record Supplier grade & the post of Draughtsman will be fill/ Recruitment by promotion/transfer from Tracer grade. And as per MoD No. 52(2)/96/III/A/D(Fy.II) dated 01.07.1996 the post of Draughtsman which later merged with post of Chargeman Grade. II/Tech (pre revised pay scale Rs. 1400–2300). Sir, therefore, the above erstwhile NIE ‘D’, who are completed 12 & 24 years regular service in the grade of Orderly/ Duftry/Poddar/ Blue Printer & Record Supplier before or upto 31.08.2008, first of all, they are entitled for ACP–I in the revised Grade pay of Tracer grade & for ACP–II in the revised Grade pay of Chargeman/Tech. grade in Ordnance Factories Organisation between 01.01.2006 to 31.08.2008 in promotional hierarchy under ACP scheme.

    Upon introduction of ACP scheme through DOPT OM No. 35034/1/97-Estt(D) dated 09.08.1999 Central government employees were granted two financial up gradation on the completion of 12 & 24 years of regular service respectively in the same post. According to the ACP Scheme, the central Govt. employees

    were to be granted next higher pay scale of their Promotional Hierarchy as financial up gradation under ACP Scheme. So the pay equal-ant to the promotional post had been ensured under ACP scheme for the government servants after completion of 12 and 24 years of regular service if they were not granted regular promotion. The financial upgradation under ACP scheme will be given to the next higher grade in accordance with the existing hierarchy in a cadre or category of post without creating any new post. And residency period in a particular post may not be taken as requisite condition for granting Upgradations under ACP scheme, as per DOPT OM F. No. 35034/1/97/-Estt(D)(Vol. IV) dated 10.02.2000, up-gradations under the scheme are to be allowed on completion of 12/24 years of service counted from direct entry in the Govt. employment. If an employee gets first regular promotion on completion of 20 years of service he will be entitled to second financial up-gradation under ACPs on completion of 4 years of service after such first regular promotion through the Recruitment/Service Rules prescribe higher length of regular service in the grade for next promotion.

    And thereafter, in terms of DOPT OM No. 35034/3/2008-Estt (D) dated 19.05.2009, DOPT OM No.35034/3/2008-Estt.(D) dated 16.11.2009 & DOPT OM No.35034/3/2008-Estt.(D) dated 09.09.2010, after completion of 10/20/30 years regular service from 01.09.2008 or after 01.09.2008, MACP–I/II/III will be granted in grade pay hierarchy under MACP scheme. But the all Ordnance Factories is using own methodology during the grant of ACP & MACP to above erstwhile NIE ‘D’ cadres and granted ACP–I in Grade pay hierarchy Rs. 1900/- & ACP–II as a Rs. 2000/- under ACP scheme between 01.01.2006 to 31.08.2008 and Rs. 2400/- as a MACP–III from 01.09.2008 under MACP scheme, which is not as per norms of ACP & MACP scheme and it is absolutely violation of DOPT guidelines & Recruitment/Service Rules, 1989, SRO–14(E) of 04.05.1989 .

    Respected comrade, in the light of above, you are therefore requested to kindly look into matter and please pursue & expedite to DOPT & MoD for issue a clarification/directive to OFB Kolkata regarding uniformly implementation of ACP scheme between 01.01.2006 to 31.08.2008, according to DOPT OM No. 35034/1/97-Estt(D) dated 09.08.1999 & DOPT OM F. No. 35034/1/97/-Estt(D)(Vol. IV) dated 10.02.2000 & MACP scheme w.e.f. 01.09.2008, as per DOPT OM No. 35034/3/2008-Estt (D) dated 19.05.2009, DOPT OM No.35034/3/2008-Estt.(D) dated 16.11.2009 & DOPT OM No.35034/3/2008-Estt.(D) dated 09.09.2010 in proper & justified manner without any partiality and grant of ACP–I & II between 01.01.2006 to 31.08.2008 in promotional hierarchy under ACP scheme and MACP–I/II/III w.e.f. 01.09.2008 in Grade pay hierarchy under MACP scheme to above erstwhile NIE group ‘D’ cadres as per norms of above DOPT OMs & existing Recruitment/Service Rules, 1989 in all Ordnance Factories, just like grant of ACP & MACP to other upgrade & merged of pre revised pay scales & post of NG cadres i.e. SH/Foreman/ Asstt. Foreman & JWM, Chargeman–II & I and NIE cadres i.e. Assistant & O.S, PA – II & I etc in 6th CPC revised Grade pay according to above DOPT OMs & existing Recruitment/Service Rules, 1989; SRO–13(E) & SRO–14(E) of 04.05.1989 in same Organisation.

    Every body knows that the medical expdr is so high today and every family has suffered by the various kind of illness. The lower paid employee did not carry the burden of treatment, so if it possible then please ensure to cover the CGHS facilities to all Defence civilian employees. Armd forced personnel and Defence civilians are work together but Armd force personnel and their family are very much secured by the medical coverage but we are not., We are lost our friend (Raj Kumar Gupta, CMD OG) on 22 Feb 2014 and his family did not have sufficient money for treatment. It is very burning issue today. Please take necessary action to extend the CGHS Facilities upto Kancharapara or Barrackpore to provide the maximum benefit to the Defence Employees. The extended area shall cover The Ordnance Factory and Metal & Steel Factory, Ishapore ESD Kankinara , 507 ABW, GE Barrackpore, GE Ishapore etc
